BREAKING: Court strikes out INEC’s application against Senator Dino Melaye
A Federal High Court in Abuja has struck out the application by the Independent National Electoral Commission (INEC) to serve the recall petition against Senator Melaye by substituted means rather than personal service.
Justice Nnamdi Dimgba on Thursday struck out the application after INEC counsel, Yunus Ustaz (SAN) applied to withdraw it.
Dimgba also ordered the transfer of all pending applications to the Court of Appeal.
The judge added that the application filed by Melaye, the senator representing Kogi West, for a stay of execution of the verdict, should also be taken to the court.
INEC had on Sept. 15 filed the ex-parte motion seeking substituted service of the recall petition on Melaye.
